By using or browsing this site ("the Site"), you have read, understood and agree to be bound by these Terms and Conditions and any other guidelines or rules applicable to other services that may be posted from time to time. We will always respect your privacy and any personal communication between you and ourselves. We do not trade, rent or sell your details to any third parties. Should our intentions change it will be done only with your authorisation. We will always comply with any data protection legislation currently in force.

If you have registered your interest with Virgin Vie At Home Limited ("Virgin Vie At Home ") and/or any of our associated companies, and thereby given your consent, you may be contacted with relevant promotions, offers or information that you have expressed an interest in or that might be of interested to you. With Virgin Vie At Home YOU are always in control of your personal information, if at any time you wish us to stop contacting you then simply phone us on 0845 300 8022. Alternatively, you can "tick" the option requesting that no further information to be sent to you from Virgin Vie At Home on the Customer/Hostess details page found within Ordering.

Information Collection and Use

We collect name, address, phone numbers, and credit card details only when voluntarily submitted by you to us for the purpose of a product order. We may also collect information on sex, status, and family to personalise marketing materials. The Site uses cookies for the purpose of record keeping. Cookies are transferred onto your hard disk to enhance the usefulness of the Web by storing information about your preferences on the Site. The use of Cookies is an industry standard to provide useful information and features for the customer. They do not personally identify the user, but only the user's computer. The majority of browsers are set to accept Cookies, but you can set you computer to refuse them. This will affect the performance of the Site, as you will not be able to access the Virgin Vie At Home Product catalogue.

Our Obligations

Virgin Vie At Home will provide you with up to date information on the functionality of the Site, and advice and assistance on any upgrades or changes to its functionality; and use reasonable endeavours to comply with any statute, regulation or other ordinance as and when they come into force.

Your Obligations

You agree that you will only use the Site in accordance with these Terms and Conditions and shall ensure compliance with applicable laws and regulations.

Exclusion of Warranty

We try to make sure the information contained on this Site is as accurate as possible. However we give no warranty of any kind regarding the Site and/or any materials provided on the Site. Virgin Vie At Home does not warrant the accuracy, completeness, currency, or reliability of any of the content or data found on this Site and to the extent permitted by law Virgin Vie At Home expressly disclaims all warranties and conditions, including implied warranties and conditions or merchantability, fitness for a particular purpose and non-infringement, and those arising by statute or otherwise in law or from a course of dealing or usage of trade. Virgin Vie At Home assumes no responsibility and shall not be liable for any damage to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the Site. In no event shall Virgin Vie At Home be liable for any injury, loss, claim, damage, or any exemplary, punitive, indirect, incidental or consequential damages of any kind (including but not limited to lost profits or lost savings) whether based in contract, tort, strict liability, or otherwise, which arises out of or is in any way connected with:

1. any use of this Site or content found herein
2. any failure or delay (including, but not limited to) the use of or inability to use any component of the Site
3. the performance or non-performance by Virgin.com even if such party has been advised of the possibility of damages to such parties or any other party
4. the provision of or failure to provide services
5. any information, software, products, services and related graphics obtained through the Site

Virgin Vie At Home liability shall not be limited in the case of death or personal injury directly caused by Virgin Vie At Home negligent act or omission.

Any dealings you have with third parties via the Site are your responsibility. Should a dispute arise between yourself and any third party due to use of the Site we will do our best assist its resolution but will not be responsible for any loss or damage may suffered as a result

Affiliates/links to other Sites

We may provide links to other Sites, resources, advertisements or sponsorships either directly or through the contractual partners. Virgin Vie At Home accepts no responsibility for these links and does not endorse their contents. If you decide to access other web sites, you do so at your own risk whatsoever. You shall indemnify and keep Virgin Vie At Home indemnified against all actions, claims, losses, costs (including all legal costs actually incurred or otherwise), damages and expenses that are suffered or incurred by Virgin Vie At Home and any affiliated or associated company or entity whether or not reasonable or otherwise foreseeable or avoidable which arise directly or indirectly from any breach or alleged breach by you of any of these Terms and Conditions.

Copyright & Trademark

The Site and each of its modules, including but not limited to text, graphics, logos, button icons, images, audio clips and software, is the property of Virgin Vie At Home. None of the data or content found on the Site may be reproduced, republished, distributed, posted, sold, transferred, linked to or modified without the express written permission of Virgin Vie At Home. In addition, the trademarks, logos and service marks displayed on this Site ("the Trade Marks") are registered and nothing contained in this Site should be construed as granting by implication, estoppel, or otherwise, any licence or right to use any of the Trade Marks without Virgin Vie At Home's permission. "Virgin Logo ("V" in a circle)", "VIRGIN", "VIRGIN COSMETICS", "VIRGIN VIE AT HOME", "VIE" and "VIRGIN VIE" are trade marks of Virgin Enterprises Limited. All other intellectual property rights (including any patent, copyright, database rights, registered design, trade mark, trade name, know-how or industrial or intellectual property right subsisting anywhere in the world and any applications to protect any of the above) and goodwill in and relating to the Site (including all components developed and produced for the Site including the up-dates, format, art direction, look and feel and content) (the "Intellectual Property Rights") shall be owned by and vest absolutely in Virgin Vie At Home.

Conduct

Virgin Vie At Home reserves the right to cancel your order or to terminate your Consultant Agreement if Virgin Vie At Home believes that your conduct as a Consultant breaches these terms & conditions.

Information Confidentiality

Virgin Vie At Home's Genealogies (being the information held by Virgin Vie At Home relating to its Consultants which at Virgin Vie At Home's option may include but are not limited to its relationships with each of its Consultants, the sponsorship of each Consultant, the Consultant's upline and down-lines and historical purchasing information for each Consultant contain confidential information which is highly sensitive and valuable to Virgin Vie At Home, and shall at all times remain the property of Virgin Vie At Home. In the event that Virgin Vie At Home discloses details of any of its Genealogies to you via this site you will at all times and without limit in time treat such details as confidential information in the nature of a trade secret. You shall not use, disclose or permit the use or disclosure of any such details to any other person (and shall take all reasonable steps to protect and maintain the security of the information). You shall use the details solely for the benefit of your Virgin Vie At Home business and of Virgin Vie At Home and for the stated purpose for which they were provided.

Ordering

Currently, we do not sell product direct to the general public via the Internet. Sales are only taken through a Virgin Vie At Home Independent Consultant. Where customer orders are placed by you, the Virgin Vie At Home Consultant, it is your responsibility to ensure that all information relating to the order(s) is entered correctly and whilst we will make every effort to verify the correctness of your order(s) [and your order details will be confirmed back to you by e-mail], Virgin Vie At Home will not accept responsibility for errors or omissions caused by incorrect data entry by you. No contract shall subsist between you and Virgin Vie At Home for the sale to you of any product unless and until Virgin Vie At Home accepts your order.

Promotional Goods

From 1 June 2001 all promotional goods not for resale, such as gifts, will be supplied by
Virgin Vie At Home (Marketing) Limited.

Purchase Terms

All products are subject to availability and may be withdrawn at any time. The price of items is the price on the day of your order. Virgin Vie At Home reserve the right to change any price before you place an order. Virgin Vie At Home try to ensure that all prices displayed are accurate but the price on your order and your order itself will need to be validated prior to processing your order. Where an item's correct price is higher than the price stated on your order, Virgin Vie At Home will contact you to let you know the current price and give you the opportunity of cancelling before your order is despatched. All prices on the Site are the same as in our Retail stores and are inclusive of VAT. With exception of the occasional special promotional offers and or Consultant price offers. Such offers will be clearly stated. Postage and packaging is charged at an additional rate.

Orders will only be accepted with payment by cheque, Visa, MasterCard and Switch. All orders paid by cheque will processed on receipt of the cheque payment into Head Office. Orders that were sent through with incomplete payment information will be kept on hold. You will be notified if this happens and if the correct information is not received within 2 weeks of notification then the order will be cancelled. If items are not in stock but Virgin Vie At Home are accepting orders for the items then they will be placed on back order. We will compare the total value of the order with the payment authorised by you. If the total order value is more than the payment you have authorised then we will contact you for authorisation for a further payment to be taken from your credit/debit card. The whole order will be held until full payment has been authorised by you.

Returns

All product returns follow the same procedures currently in place. Call 0845 300 8020 to request a returns form and a free post label. All returns must be reported within 30 days of the purchase date, excluding those returns due to allergies.

Security

All credit card details submitted are encrypted through the use of the software called SSL. Encryption provides a very secure means of protecting your personal information as it travels through the web to us.

Severability

These Terms and Conditions shall be deemed severable. In the event that any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.

Entire Agreement

These Terms and Conditions, together with those incorporated herein or referred to herein constitute the entire agreement between us relating to the subject matter hereof, and supersede any prior understandings or agreements (whether oral or written) regarding the subject matter.

Governing Law

These Terms and Conditions shall be governed and interpreted in accordance with the laws of England and Wales
